The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

• Plans refer to the electricity or natural gas Plans offered by Energy Suppliers on our website.
• Enrollment Requests mean a request by You to enroll on a Plan with an Energy Supplier.
• Plan Documents mean documents including and without limitation the Energy Supplier’s Terms & Conditions, Terms of Service, Electricity Facts Label (EFL), Your Rights As a Customer (YRAC), Legal Disclaimers, and Environmental Disclosures.
• Promotions refer to contests, sweepstakes or other promotions offered through the Website.
• Terms and Conditions (also referred as "Terms", Terms & Conditions) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Website.
• Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Website.

• You means the individual accessing or using the Website, or the company, or other legal entity on behalf of which such individual is accessing or using the Website, as applicable.

By submitting an Enrollment Request for a Plan through the Website, You warrant that You are legally capable of entering into binding contracts.

If You wish to place an Enrollment Request for a Plan that is available on the Website, You may be asked to supply certain information relevant to Your Enrollment Request including, without limitation, Your name, Your email, Your phone number,  Your date of birth, Your utility account number, Your service address, and Your mailing address.

You represent and warrant that the information You supply to us is true, correct and complete.

If you wish to cancel an Enrollment Request that you submitted on Our Website, you will be to contact that applicable Energy Supplier. We cannot process the cancellation request for you.

We are constantly updating Our offerings of Plans on the Website. The Plans available on Our Website may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Plans on the Website and in Our advertising on other websites.

We cannot and do not guarantee the accuracy or completeness of any information, including Plan prices, Plan descriptions, cancellation fees and etc. We recommend that You thoroughly read the Energy Supplier’s Plan Documents before you submit an Enrollment Request.  We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Any Promotions made available through the Website may be governed by rules that are separate from these Terms.

If You participate in any Promotions, please review the applicable rules as well as our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

When You create an account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Website.

You are responsible for safeguarding the password that You use to access the Website and for any activities or actions under Your password, whether Your password is with Our Website or a Third-Party Social Media Service.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

You assign all rights, title and interest in any Feedback You provide the Company. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify, and exploit such Feedback without restriction.

Our Website may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Website will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Website.

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to 100 USD.
